Terms of Service
1. Scope
These Terms of Service (“Terms”) apply to all contracts between
Tunerfiles.de / Volkan Gökgündüz (hereinafter referred to as the “Provider”)
and the customer regarding the purchase of digital tuning files via this website.
2. Subject of the Contract
(1) The Provider supplies digital tuning files for engine control units (ECU).
(2) All products are delivered exclusively in digital format (download).
(3) No physical goods will be delivered.
3. License and Permitted Use
(1) Upon purchase, the customer is granted a non-exclusive, non-transferable, single-use license.
(2) Each file is licensed for one specific vehicle / ECU only (VIN-bound if applicable).
(3) The following is strictly prohibited:
* Reselling or sublicensing
* Sharing or distributing files
* Publishing or making files publicly accessible
* Using files for commercial resale (unless explicitly authorized as a reseller)
4. Dealer / Reseller Clause
(1) Commercial use or resale of files is only permitted with explicit written approval from the Provider.
(2) Authorized resellers are fully responsible for their end customers.
(3) The Provider assumes no liability for damages caused by resellers or third parties.
5. Anti-Reverse Engineering
The customer is strictly prohibited from:
* Reverse engineering
* Decompiling
* Modifying, analyzing, or extracting the structure or logic of the files
Any violation will result in immediate termination of the license and legal action.
6. File Modification and Liability
(1) Any modification of the provided files is done entirely at the customer’s own risk.
(2) The Provider accepts no responsibility for altered or modified files.
(3) Once modified, any liability of the Provider is fully excluded.
7. Disclaimer of Liability
(1) All files are intended strictly for off-road, motorsport, export, or testing purposes only, unless otherwise stated.
(2) The Provider shall not be held liable for:
* Engine or vehicle damage
* Mechanical or electrical failures
* Loss of warranty
* Legal consequences or fines
* Loss of registration or road legality
(3) Use is entirely at the customer’s own risk.
(4) The customer is responsible for compliance with local laws and regulations.
8. Compatibility Disclaimer
(1) The customer must ensure compatibility with their specific ECU and vehicle setup.
(2) The Provider does not guarantee:
* Performance gains
* Error-free operation
* Compatibility with all hardware/software versions
9. No Refund Policy
(1) Due to the nature of digital products, all sales are final.
(2) No refunds, returns, or exchanges will be granted once the file has been delivered.
(3) Exceptions may only be made at the sole discretion of the Provider.
10. Right of Withdrawal Waiver
(1) By purchasing, the customer expressly agrees that:
* the execution of the contract begins immediately, and
* they lose their right of withdrawal once the download starts.
(2) Therefore, the statutory withdrawal right does not apply after delivery.
11. Prices and Payment
(1) All prices are listed in Euro (€) and include applicable taxes unless otherwise stated.
(2) Payment must be completed using the available payment methods.
(3) Files are only delivered after full payment has been received.
12. Availability of Service
(1) The Provider aims to ensure continuous availability.
(2) However, downtime or interruptions may occur and are not grounds for claims.
13. Intellectual Property Rights
All files, software, and content are protected by copyright and intellectual property laws.
Unauthorized use will result in legal action.
14. Limitation of Liability
To the fullest extent permitted by law, the Provider’s liability is excluded.
In any case, liability is limited to the amount paid for the product.
15. Governing Law and Jurisdiction
(1) These Terms are governed by the laws of the Federal Republic of Germany.
(2) The place of jurisdiction is the Provider’s registered office, where legally permissible.
16. Severability Clause
If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.
